The company filed a writ petition challenging the said order before the Hon’ble Calcutta High Court (W.P. No. 3667(W) of 2019) before the Hon’ble Single Bench, which was decided against the company. Subsequently, the company filed an appeal before the Hon’ble Division Bench of the Calcutta High Court (MAT No. 364 of 2023) which is currently pending final adjudication. | The appeal filed before the Hon’ble Division Bench of the Calcutta High Court has already been substantially heard but pending final adjudication. While the appeal was pending before the Hon’ble Division Bench, the jurisdictional authority issued a Show Cause Notice and passed an Order-in-Original dated 15 March 2024, confirming the demand of differential GST along with applicable interest and penalty. The company filed an appeal under Section 107 of the CGST Act, 2017 on 23.10.2024 before the Commissioner (Appeals-II), which was rejected vide Order-in-Appeal dated 23 June 2025, thereby upholding the demand in full. The company intends to file a second appeal before the GST Appellate Tribunal within the prescribed statutory limitation period under the relevant provisions of the CGST Act, 2017 and the rules made thereunder, as and when the Tribunal is constituted. | |
